Delta 8 THC in Florida: Its Laws, Its Products, and Its Future

It can be difficult to keep up with the constantly changing world of cannabis. There are always new products and laws that change.

The complicated matter of Delta-8 THC is a difficult one. It's legal in federal court, and it is similar to Delta-9.

What makes Delta-8 legal? What is the point of contradicting laws?

This article will discuss Delta-8 in Florida, including its laws, products, and future prospects in the Sunshine State.

What is the Difference between Delta-8 and Delta-9 THC

THC is usually used to refer to Delta-9 THC. There are many forms of THC. However, Delta-9 THC is the one that gives marijuana its psychoactive properties.

What is Delta-8 and what makes it different from Delta-9 THC?

Delta-8, an isomer Delta-9, is a simplified version of Delta-9. This means that Delta-8 and Delta-9 may look similar, but have different chemical structures.

Delta-8 gives you a milder, more mellow high that has fewer side effects. This is especially beneficial for people who feel anxious after using marijuana.

Both Delta-8 and Delta-9 offer very similar experiences, aside from side effects and intensity.

Is Delta-8 Safe?

Delta-8 is considered safe. This is due to the fact that Delta-8 THC is about half the potency of Delta-9, making it more difficult to cause side effects.

Delta-8 has been shown to have fewer side effects than other forms of marijuana, making it easier to use for people who are sensitive to cannabis.

Is Delta-8 legal in Florida?

The 2018 Farm Bill states that Delta-8 THC has federal legal status, even though the language is ambiguous. It is worth noting, however, that some states have banned it, such as Vermont and Iowa.

This is because Delta-9 is illegal but there is nothing in the Farm Bill that addresses Delta-8. Delta-8 can also be made from industrial hemp which is legal under federal law.

Industrial hemp is currently defined as Cannabis Sativa when the plant contains 0.3% Delta-9 or less THC. The federal government attempted to clarify this issue in 2020.

They stated that all synthetically derived cannabinol tetrahydrocannabinol are Schedule I controlled substances. However, this clarification is misleading because Delta-8 does occur naturally in hemp.

So, Florida legalizes Delta-8 THC as long as it is from hemp that has a THC content below 0.3%.

Is Delta-10 legal in Florida?

At the moment, Delta-9 THC is the only THC isomer that is banned in Florida. Both Delta-8 THC and Delta-10 THC can be legally obtained in Florida.

Is Delta-8 A Natural Compound?

Many people have the same question as Delta-8: Is it natural?

It all depends on your definition of "natural."

Let's be very clear: there is no regulation regarding the meaning of "natural". Marketing tactics often use the term's meaning to make sales pitches.

Delta-8 can be found naturally in hemp but it can also be synthesized from CBD. It can also be naturally derived from Delta-9 THC.

FDA and DEA have removed terms such as "natural", "artificial", and "synthetic" from their vocabulary because they are not relevant to product performance.

The PACT Act & Delta-8 Vapes

The government passed the "vape ban" in December 2020. Also known as the Preventing Online Sales of E-Cigarettes to Children Act.

This bill requires that e-commerce vendors:

  • Demonstrate that the customer has a legal age
  • Ship via private shipping
  • To receive the package, you must be at least 18 years old and have a valid ID
  • The package should be labeled as a tobacco product
  • Register your products with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), US Attorney General, and state and local tax bureaucrats
  • All tax stamps that the state requires you to comply with
  • Send the tax administrator of the state a list of all transactions, customer names, and types of products. Also, include any nicotine-containing products.

This Act covers all vape products, including Delta-8 vape cartridges. The Prevent All Cigarette Trafficking Act (or PACT Act), prohibits vapes and electronic cigarettes from being delivered by the US Postal Service. UPS and FedEx are also considering banning vape products.

Vapers' Future with Delta-8

What does this mean for Delta-8 vapers?

It is obvious that there will be dramatic changes in the future, but vape vendors and the market are adapting as best they can. The potential results are encouraging.

Customers may face increased shipping costs due to the restrictions. These restrictions are important as they will help you stay informed about legitimate sources. Do not order from a Delta-8 company if they don't verify your identity or require identification upon delivery.

Delta-8 THC: How do you use it?

You can expect the same variety with Delta-8 CBD oils, gummies, and topicals. Finding the right Delta-8 product for you can sometimes be difficult. Here's a quick overview of the most common Delta-8 products.

Tinctures and Oils

Although oils and tinctures may not be the most flashy, they are some of the most versatile. You can either put a few drops of Delta-8 oil under your tongue or add them to your favorite snack.

Gummies

Gummies are very popular in the CBD industry. This is also true for Delta-8.

Delta-8 gummies take longer to kick in because they must be digested first before they enter the bloodstream. However, they are a delicious and effective treatment that is both tasty and very enjoyable.

Vape Carts

Vape carts are known for their high bioavailability and fast-acting effects. The learning curve for Delta-8 vapes will be almost nonexistent if you have ever vaped CBD or nicotine.
