Are THC Gummies Legal in The US?
Gummies are one of the most beloved edible cannabis products, accounting for 70% of sales in six states that legalized recreational marijuana in 2021. Meanwhile, hemp-derived CBD/THC gummies continue to see steady growth across more states.
Consumers unfamiliar with cannabis products such as edibles may often ask whether THC gummies and edibles are legal. This question arises in part from cannabis legality being so subjective in the U.S.; cannabis restrictions have been relaxed across many states while it remains illegal on a federal level, leading to some confusion as to the status of THC products such as gummies and whether they fall within their legality scope or not.
Cannabis legality varies across states in the US and can be difficult to navigate. This blog explores THC gummies' legal standing across North America and Europe so you can determine if you live according to the law in your region and can consume THC edibles safely.
Understanding THC Edibles
People have long used cannabis extracts in food. Modern-day infusing is much more advanced; advanced extraction techniques like CO2 extraction allow manufacturers to infuse products with precise cannabis concentrations.
THC edibles - including gummies and other candies, confections, and beverages - can be found everywhere from vending machines to coffee shops and specialty food stores. Gummies in particular dominate this sector due to their taste, convenience, and ease of production.
Gummies made using this method combine pure THC oil with natural flavors and binding agents such as pectin for an edible form of THC that tastes sweet, fruity, and similar to candy; yet is far more potency than its conventional counterparts.
THC added to edibles can produce an intoxicating high that is both desirable and undesirable if handled irresponsibly. As cannabis and related products contain THC, which has mind-altering properties, many countries regulate THC use to prevent adverse consequences for human beings.
Hemp Vs Marijuana: What Are My Options?
Cannabis comes in two legal forms - marijuana and hemp.
Industrial Hemp Industrial hemp refers to cultivars of Cannabis with less than 0.3% THC content and has multiple industrial applications, from paper and cloth manufacturing, biodiesel production, auto parts fabrication, and even health supplement products such as CBD oil or cannabinoid extracts.
Since the Farm Bill legalized hemp production in 2018, production has drastically increased and with it, the availability of CBD products like extracts, edibles, and balms. More recently, federally legal edibles like THC gummies or oil have also been produced due to a 0.3% THC weight limit; some state laws still restrict such products making it inaccurate to state that they are legal everywhere.
Marijuana (Cannabis sativa) and industrial hemp share many traits, however, marijuana contains higher levels of Tetrahydrocannabinol than found in hemp plants; some strains may even contain up to 30%.
Marijuana is subject to more stringent regulation due to its psychoactive properties, remaining illegal in most parts of the globe. But public perception has changed rapidly regarding cannabis use worldwide and more countries have revised and reconsidered their marijuana laws accordingly.
THC "Delta" Types
There are three forms of delta THC available today, known delta-8 THC (also referred to as delta-9 THC), industrial hemp10 THC, and delta-10 THC. Delta-9 THC contains the highest concentration and psychoactive properties and can be found in products like delta-9 THC gums; delta-8 and delta-10 are found naturally within cannabis plants but in lower quantities than its more popular version; they are considered fewer potency options.
Delta-8 and Delta-10 THC present legal complexities and contention that are hard to define given that only delta-9 THC is covered under the Farm Bill. Both cannabinoids can be found in smaller quantities in cannabis; to produce enough to sell on the market it often becomes necessary to synthesize. Unfortunately, in many US states with legalized marijuana such as Colorado and Oregon these synthetic cannabinoids are illegal despite being artificial substances produced synthetically - even where the cultivation has already taken place!
Are THC Gummies Legal?
Cannabis restrictions are loosening globally at an unprecedented pace. Cannabis products continue to proliferate as stigma and negative perceptions fade - creating compelling arguments in favor of legalization that was once considered unthinkable.
United States
Since 1970 when the Controlled Substances Act was passed in America, cannabis has been classified as a Schedule I controlled substance under Federal law. But ongoing research on its therapeutic potential and shifting cultural perceptions around its acceptance present compelling arguments against its classification in this class.
California was the first state in 1996 to legalize medical cannabis; Colorado and Washington followed in 2012 by legalizing recreational marijuana use. By 2023, recreational marijuana will have been legalized across 21 U.S. States (including DC). Medical use will still be legal in 11 of them while CBD oil may also be used medically in select cases.
THC gummies derived from hemp with an upper dry weight limit of 0.3% are legal across most of the US. Each state imposes different regulations regarding edibles; Colorado only permits 10mg THC per serving from edibles made with either cannabis or hemp.
When Canada passed the Cannabis Act in October 2018 making them only second behind Uruguay to legalize recreational cannabis nationwide, THC edibles were only legalized one-year post-Cannabis Act with stringent regulations imposed upon their production.
Canada
Canada's cannabis laws vary between provinces. Some areas have tighter restrictions than others; Quebec for instance imposes an age limit to purchase recreational marijuana of 21 and does not permit home cultivation; most other provinces allow up to four plants in each household and the legal age of purchase is 19.
Canada has stringent regulations for THC-infused gummies, edibles, and other products sold here, such as childproof packaging and clear labeling of cannabinoid content and serving sizes; additionally, there can be no health claims made regarding any product sold there.
Europe
The legality of THC Gummies and related cannabis-related products in Europe differs depending on your country of residence. The European Union recently authorized the cultivation of industrial hemp with up to 0.3% THC content, thus loosening restrictions on CBD oil products; however, THC gummies, CBD oil products, and edibles remain restricted within Europe.
Most European nations have decriminalized recreational cannabis use and legalized medical cannabis, though some countries such as Germany are working towards legalizing recreational marijuana nationwide.
